If you or your food business is convicted or found guilty of an offence against the Food Act 2001 a summary will be published to the Register of Food Offences.

Offences on the register may include the handling or sale of unsafe food or failure to comply with the Australia New Zealand Food Standards Code.

Publishing offences to the register is a requirement of the Food Act and increases transparency in food regulation by publishing details of convicted offences in one place. It helps consumers make informed decisions about where they eat or buy their food.

The register contains:

  • the name of the individual or company found guilty of an offence
  • the food business address
  • the date of the offence
  • the court penalty

Information is not published on the register if a non-publication order has been made by the court.

Information is published on the register for up to 2 years from the date of first publication.

Applying to change the food offence register

You may apply to the Chief Health Officer to change the register at any time.

The register can be changed to correct an error or omission, add information to the Register where a business has been sold or liquidated following a convicted or guilty offence, or to add or remove information the Chief Health Officer considers inappropriate.

To apply for a change to the Food Offences Register:

  1. You must complete the application for a change to the register form.
  2. Include any supporting documents.
  3. Fax the application to 02 5124 9305, or post it to Health Protection Service, Locked Bag 5005, Weston Creek ACT 2611

If your application is illegible or incomplete it will be returned to you for more information. If you need to discuss the application process, contact the Health Protection Service on (02) 5124 9700 or email hps@act.gov.au.

Review your decision

You will be notified of the outcome of your application to change the register. If you do not agree with the outcome, you can ask for a review by writing to the Health Protection Service at the address above.
